1. Agreement
These Terms of Use are a legal agreement between you and Ron Vaisman, the developer of Levity, and not Apple. They govern your download, access, purchases, and use of the Levity iPhone application. By downloading or using Levity, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.
Apple’s Standard Licensed Application End User License Agreement applies to your license unless a custom EULA is provided through App Store Connect. These Terms supplement the applicable Apple terms.
2. Eligibility
You must be legally capable of entering this agreement. If you have not reached the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use. You may not use Levity if applicable law or sanctions prohibit you from doing so.
3. What Levity does
Levity helps you review, organize, compare, and select photos and videos in Apple Photos. Swipes and similar-photo choices may stage items for later action. Nothing is removed from the active library until you confirm in Review and approve Apple’s system prompt.
Similarity matches, suggested items, file-size estimates, storage figures, counts, and progress indicators are tools for review and may not be exact. Levity is not a backup, archival, recovery, security, or guaranteed duplicate-detection service.
4. Your library and your responsibility
You retain all rights in your photos, videos, and other content. Levity does not receive a license to upload, host, publish, sell, or train models on that content. You are responsible for reviewing every selection and keeping any backup you consider necessary before confirming deletion.
Recently Deleted is controlled by Apple Photos and may be emptied by you, Apple, a device-management policy, or synchronization behavior. If iCloud Photos is enabled, a deletion can sync to other devices using the same Apple Account. Permanent deletion may be irreversible.
5. Privacy and permissions
Levity’s handling of information is described in the Privacy Policy. You control Photos permission through iOS Settings. Some core features cannot work without access to the relevant Photos items. You are responsible for having the right to view and manage content stored in the library you authorize.
6. License
Subject to these Terms and the App Store Usage Rules, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Levity on Apple-branded products that you own or control. Family Sharing or volume-purchase access is permitted only where Apple’s rules allow it. The app is licensed, not sold. We and our licensors retain all rights not expressly granted.
7. Acceptable use
You may not:
- rent, lease, sell, sublicense, redistribute, copy, modify, or create derivative works from Levity;
- reverse engineer, decompile, or attempt to discover source code except where applicable law expressly permits it;
- bypass usage limits, purchase checks, security, or access controls;
- interfere with the app or Apple services;
- use Levity unlawfully or to violate another person’s rights; or
- remove legal or ownership notices.
8. Free use and paid products
Levity currently offers a free allowance of 50 swipes per day and paid products through Apple In-App Purchase. The purchase screen shows the products available to you, the current localized price, and the included access before you confirm payment. We may change future free limits or offerings, but a completed paid purchase remains governed by the terms shown when purchased and applicable law. Deleting items already staged in Review is not conditioned on a later purchase.
9. Annual subscription
Levity Annual is an auto-renewing subscription with a one-year billing period. Payment is charged to your Apple Account when you confirm purchase. It renews automatically for another year at the price Apple presents unless you cancel at least 24 hours before the current period ends. Apple manages billing, renewal, price-change consent where required, cancellation, and refunds.
You can cancel or manage the subscription in iOS Settings or your App Store account. Cancellation stops future renewal and access continues through the paid period, subject to Apple’s rules. Levity does not offer an auto-converting free trial unless one is expressly shown by Apple at purchase.
10. Lifetime Unlock
Lifetime Unlock is a non-consumable purchase, not a subscription. It unlocks Levity’s premium features and future premium features released as part of the same Levity app and bundle identifier, for as long as Levity is made available and supported and remains compatible with your device and operating system. It does not include a separate app, product, or third-party service. “Lifetime” does not guarantee that the app, App Store, device, or operating system will exist or be supported forever.
11. Billing, restoration, and refunds
Apple processes all payments. We do not receive your payment card details. Purchases are tied to the Apple Account used for the transaction and can be restored through Levity where Apple permits. Refund requests and billing disputes must be submitted to Apple and are governed by Apple’s policies and mandatory consumer law. Prices can differ by country and may include taxes.
12. Updates and availability
We may provide fixes, updates, or feature changes and may discontinue parts of Levity when reasonably necessary for security, law, platform requirements, technical limits, or product operation. Some updates may be required for continued use. We do not promise uninterrupted availability, compatibility with every device or iOS version, or continued availability in every country. These Terms do not limit any non-waivable rights you have for paid digital content.
13. Maintenance, support, and Apple
Ron Vaisman, not Apple, is responsible for Levity’s maintenance and support to the extent required by law. Apple has no obligation to provide maintenance or support. Contact us at ronvaisman@gmail.com.
Apple is not responsible for claims relating to Levity or your possession or use of it, including product-liability, legal-compliance, consumer-protection, or intellectual-property claims. We, not Apple, are responsible for addressing those claims.
14. Warranty
Levity is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that Levity will find every similar item, estimate storage exactly, prevent unintended selections, operate without interruption, or recover deleted content.
If Levity fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation. Nothing here excludes a warranty or remedy that applicable law does not allow us to exclude.
15. Limitation of liability
To the maximum extent permitted by law, Ron Vaisman will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, photos, videos, profits, goodwill, or use arising from Levity. To the maximum extent permitted by law, total liability for all claims relating to Levity will not exceed the greater of the amount you paid for Levity during the 12 months before the claim or US $50.
These limits do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any liability that law does not permit us to limit. Your local consumer law may provide additional rights.
16. Suspension and termination
You may stop using Levity and delete it at any time. This agreement terminates automatically if you materially breach it. On termination, the license ends and you must stop using and delete the app, but provisions that by their nature should survive will remain in effect, including ownership, warranty limitations, liability limits, and dispute terms. Termination does not itself create a refund right or override Apple’s purchase rules or mandatory law.
17. Governing law and consumer rights
To the extent permitted by mandatory law, these Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and disputes are subject to the competent courts of Tel Aviv-Jaffa, Israel. If the law where you reside gives you mandatory consumer protections or a right to bring proceedings in your local courts, those rights remain unchanged. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
18. General terms
If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions continue. Our failure to enforce a provision is not a waiver. You may not transfer this agreement except as Apple’s rules allow; we may transfer it as part of a lawful reorganization or transfer of Levity, subject to applicable law.
These Terms, the Privacy Policy, and applicable Apple terms form the entire agreement about Levity. A materially changed version will be posted with a new effective date and, where required, presented for acceptance.
19. Apple third-party beneficiary and contact
You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce the Terms against you as a beneficiary.
