Terms of Use
These app-specific terms supplement Apple's Standard EULA for NoiseNest, operated by Ron Vaisman in Israel.
Agreement and Apple terms
By downloading or using NoiseNest, you agree to these terms and Apple's Standard Licensed Application End User License Agreement. Apple's agreement remains the primary license for the app. If these terms conflict with mandatory law or Apple's applicable terms, the mandatory or Apple term controls to the extent of the conflict.
License and permitted use
NoiseNest grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control under Apple's Usage Rules. You may use it for personal sleep, relaxation, focus, and ambient listening.
Acceptable use
You may not copy, sell, redistribute, extract, publicly perform, sublicense, reverse engineer, defeat purchase controls, interfere with the service, or use NoiseNest audio to create a competing sound library, except where applicable law expressly permits an activity that cannot be restricted by contract.
NoiseNest Pro
NoiseNest Pro is an optional non-consumable lifetime purchase processed by Apple. It is not a subscription. The App Store shows the applicable local price before confirmation. Access is associated with the purchasing Apple Account and remains subject to Apple's purchase, Family Sharing, refund, account, and territory rules. Use Restore Purchases to check a verified entitlement.
Refunds and billing
Apple is the merchant and payment processor for App Store purchases. NoiseNest cannot issue App Store refunds or change Apple billing records. Submit billing and refund requests through Apple's Report a Problem.
Downloads and availability
Core sounds are bundled or generated on-device. Extended sounds are delivered through Apple-managed resource packs. Download availability, speed, storage retention, and background continuation depend on Apple services, network conditions, device storage, and iOS. A downloaded pack may need to be downloaded again if iOS reclaims it.
Schedules and notifications
Schedules create local actionable reminders. They do not guarantee unattended playback, wake-up, alarm, or delivery at an exact time. iOS may delay or suppress notifications, and a suspended app cannot silently begin audio. Do not rely on NoiseNest for emergencies, medication, safety alerts, or any time-critical purpose.
Health and safe listening
NoiseNest is a general wellness and ambient-audio utility, not a medical device. It does not diagnose, prevent, treat, or cure any condition and is not medical advice. Keep volume at a safe level and do not use NoiseNest when audio could mask alarms, warnings, traffic, people, or other important environmental sounds.
Intellectual property and sound rights
The app, design, code, brand, original sound productions, and documentation are owned by or licensed to NoiseNest. Third-party and CC0 materials remain subject to their applicable rights. Sound provenance is described on the Sound Licenses page. Purchasing Pro grants app access, not ownership or redistribution rights in individual audio files.
Changes and discontinuation
NoiseNest may fix, improve, replace, add, or remove features or sounds where reasonably necessary for security, compatibility, legal compliance, quality, or continued operation. Any material change will respect non-waivable consumer rights and access already required by applicable purchase rules.
Disclaimer
To the maximum extent permitted by law, NoiseNest is provided “as is” and “as available.” No promise is made that the app, notifications, downloads, or every audio route will always be uninterrupted, error-free, or suitable for a particular purpose. Nothing here excludes a warranty or remedy that applicable law does not permit us to exclude.
Limitation of liability
To the maximum extent permitted by law, NoiseNest and its operator are not liable for indirect, incidental, special, consequential, or punitive loss arising from use or inability to use the app. Any limitation applies only where lawful and does not limit liability that cannot legally be limited, including mandatory consumer protections.
Governing law
These terms are governed by the laws of Israel, without reducing any mandatory consumer rights you have under the law of your country or region. Disputes may be brought before a court with lawful jurisdiction.
